As a first time home buyer or home owner, you have the advantage of finding a real estate professional to provide guidance and protect your best interests. Merely working with an agent does not automatically mean that individual is your buyer or seller agent. There is generally an agreement outlining the relationship, role of the the agent, and your responsibilities. The following are some facts on why you should hire Florida real estate agents.

Real Estate Agents Fiduciary

Federal real estate law specifies that agents fulfill certain responsibilities to their clients once they enter into an agency relationship.

Maintaining Confidentiality

Agents are responsible for maintaining confidentiality. They must not disclose anything about your business, finances, or motivations unless asked by their clients or mandated by a court to do so. This responsibility remains active at all times beyond any closings or contracts.

Care

Real estate agents have a reasonable knowledge when it comes to real estate issues and on the home buying and selling process, but they are not experts in all real estate related fields (such as contract writing). For guidance on matters outside of their responsibilities, they must direct clients to the other experts.

Compliance

Agents must accept and follow their clients instructions, as long as the requests do not violate any laws. For example, sometimes clients ask their Realtors to prepare an offer with terms that the agent disagrees with. Agents must complete those requests despite the differing opinions.

Monitoring of Funds

Real Estate Agents must accurately monitor and report the whereabouts of all funds pertaining to a home sale or purchase. This applies to earnest monies given and the return of said deposits where necessary.

Allegiance

Real Estate Agents must promote the best interests of their clients ahead of any other individuals, including themselves. Commission, particularly in multiple offer situations, must not be an influece and would be disloyal. Confidentiality is also considered part of loyalty.

Timely Action

Agents must perform responsibilities and honor requests in a timely manner. This can be critical in multiple offer scenarios. It is also important once a home is under contract and must abide by specific deadlines.

Disclosure

All real estate agents must tell you all material facts about a property,…often referred to as material facts. The duty to disclose also applies to any facts that might influence decisions about a property or benefit negotiating position.

Hiring an agent has many advantages. In addition to what is mentioned above, agents have an even more influential role of influencing communication between buyers and sellers. The real estate process can be very stressful and emotional. Having the involvement of an individual who recognizes your best interests but is not emotionally involved can maintain civility and lead to positive conclusions.
